What Fatal Accidents Benefits Am I Entitled To?

If a work accident, illness, or injury results in the death of a worker, the workers’ surviving spouse and/or children (including qualifying dependent adult children or parents) are eligible to receive death benefits of 66.66% of the deceased employee’s average weekly wage.

Death benefits also include up to $3,000 in funeral expenses and are capped total at $500,000 or 25 years of weekly payments, whichever is greater.

In some cases, surviving dependents can receive Social Security death benefits. There are certain eligibility requirements. For example, the surviving spouse must be 60 years or older. Every situation is different and we can discuss how the laws apply to your particular circumstances.
