Workers' Compensation

Retaliation

What is Considered Retaliation in the Workplace?

Injured workers are often concerned about filing a claim against their employer, fearing that they might face retaliation, or negative consequences, from supervisors and managers. Don’t worry. In a workers’ compensation claim, there is generally very little interaction between your lawyer and your employer. Most of the time, we are dealing directly with your employer’s insurance company. Additionally, your employer is not allowed to retaliate against you for pursuing benefits.

What Happens If My Employer Fires Me in Retaliation?

If you are fired, you are still entitled to the work comp benefits you would receive if you were still working for your employer. Further, if evidence exists to show that you were terminated for exercising your workers’ compensation rights, you may have a claim for retaliation.

Following a work accident, contact our offices for a no-charge, no-obligation consultation. Our staff is eminently qualified to help you with all aspects of your claim. We can help you to secure the workers’ compensation benefits you need and deserve.
