Qualifying for Workers’ Comp Benefits in Illinois
Many injured workers throughout Illinois have questions about whether or not their injuries qualify for compensation. If you or your loved one has been injured, you may be wondering if you are entitled to workers’ comp benefits and if so, what benefits you can expect to receive.
At Woodruff Johnson & Evans Law Offices, our Illinois workers’ compensation attorneys can answer your questions and address any concerns you may have.
What is a compensable accident?
In order to qualify for benefits under the Illinois Workers’ Compensation Act, you must establish that you were injured in the course of your employment by a risk arising out of your employment. You also must provide notice to your employer within 45 days of your injury and file a claim within three years of the date of your accident.
You may have a work-related injury for either a specific trauma (e.g., breaking a wrist when falling on a wet floor in a cafeteria) or a repetitive trauma that occurs over time (e.g. frequent heavy lifting leading to a low back injury).
